Our client was approached by a solar developer who had agreed a potential connection with the local distribution network operator. The client sent the paperwork to our team and asked for our opinion as to the commerciality of the offer and assistance with completing the deal.
We explained the options available under the scheme and the potential payment rates for the options. We then went through the farm, field by field with the client to discuss which options may be appropriate for the land type and the commercial farming plans going forward.
We reviewed the detailed heads of terms and instructed solicitors to act on behalf of our client. The instructed solicitor had a proven track record in delivering renewable leases, particularly solar. We liaised with all parties to ensure the optimum deal was achieved including the negotiation of a complicated overage deal. We also ensured that the final lease reflected the deal agreed in the heads of terms.
Importantly we worked with the client’s existing accountant to consider how the income would impact the business in terms of cash, income and reinvestment ability.
Going forwards we continue to work with the farming family with regards to the solar farm lease, management of the land under the panels and carry out the annual RPI based rent review.
